Allan has many years experience as a professional negotiator and mediator, in addition to highly relevant educational qualifications. He has extensive experience in the field of Information Technology, and brings a deep understanding of the nuances of computing issues to disputes involving software functionality, web site design, network infrastructure, and IT related intellectual property. He also has many years experience working in the field of labour relations.

About the mediation process

The mediator acts as an unbiased facilitator, assisting parties to reach a mutually acceptable settlement to their dispute. The mediator does not make decisions on the merits of either side of the conflict, nor does he determine the final outcome. Caucus sessions are often held to facilitate reaching agreement, and the parties may or may not meet in joint sessions.

The mediation process is private, confidential, and conducted on a without prejudice basis. Aside from the legal considerations, this factor can be of tremendous value to litigants in IT/IP related disputes where it may be vital that proprietary processes and data remain confidential.

The mediator drafts a Memorandum of Understanding at the conclusion of the mediation session. The MoU is the mediator's summary of the mediation and will list the points upon which agreement was reached and/or not reached. It will be signed only by the mediator and is not a contract.

Legal counsel for the parties will draft the contract for signature by the litigants when the mediation process concludes with a settlement. The mediator's MoU may be used as an outline to assist counsel.
